3.) TERMS OF CONTRACT AND DELIVERY FOR PURCHASE ORDERS
Orders placed by distance selling are subject to the following terms of contract and delivery:

Orders for informative material are received and executed by HAMBERGER Industriewerke GmbH.

Validity
Distance contracts relating to the sending of informative material are entered into by Hamberger Industriewerke GmbH only under application of these terms. Any other terms or conditions will not become part of such contracts unless they are expressly accepted as such in writing by Hamberger Industriewerke GmbH.
In legal transactions with consumers within the meaning of the German Consumer Protection Act, the terms of contract and delivery shall be applicable in so far as they do not contradict applicable mandatory provisions of the Consumer Protection Act.
Language of Contract
The language of contract shall be German.
Ordering
Orders are placed by fully completing and submitting the Order Form which is provided on the HARO website.
Prices
All prices quoted (nominal fees) are gross prices exclusive of delivery expenses.
Consumer’s Right of Cancellation
Consumers within the meaning of the Consumer Protection Act may cancel the distance contract within a period of 14 working days from receipt of the consignment. In the event of such cancellation, the nominal fee will be reimbursed against return of the material ordered, with the cost of the return to be borne by the consumer.
The right of cancellation does not apply to video cassettes (pursuant to Section 5f of the German Consumer Protection Act [KSchG]).
Delivery Time
Basically, Hamberger Industriewerke GmbH delivers orders within 10 working days from receipt of the order. Should delivery be impossible, e.g. due to non-availability, then the customer will be notified to such effect. In any case, claims by the customer as a result of impossibility to fulfil a contract and a delay in delivery which may have occurred shall be ruled out.
Mode of Payment
The nominal fees are to be paid on a cash on delivery basis.
Set-off
Any set-off against obligations of Hamberger Industriewerke GmbH on the grounds of transactions concluded through distance selling via the website of HARO shall not be admissible.
Applicable Law / Place of Jurisdiction
The present agreement shall be governed by German law. The exclusive place of jurisdiction shall be at the place of the registered office of Hamberger Industriewerke GmbH, unless the customer is a consumer whose domicile, usual residence, or place of work is in Germany.
